Terms of Service

Welcome to FortuneOK. These Terms of Service ("Terms") govern your access to and use of the FortuneOK website, applications and services (collectively, the "Service") operated by FortuneOK ("we", "us", "our"). By creating an account or using the Service you agree to be bound by these Terms.

1. Agreement to terms

If you do not agree with any part of these Terms, you must not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The service

FortuneOK is a multi-currency investment portfolio tracker. It allows you to record assets across categories such as stocks, ETFs, bonds, crypto, options, futures, cash, real estate, vehicles, precious metals and other holdings, and to visualize allocation, performance and totals in your preferred base currency.

Market data for tradable instruments is sourced from third-party providers and may be delayed, incomplete or inaccurate. The Service is provided for informational and personal record-keeping purposes only.

3. Your account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• You can sign in with Google or with a magic link sent to your email. You are responsible for keeping that email address secure.
• You agree to provide accurate information and to keep it up to date. One person, one account.
• You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Plans, billing & trial

FortuneOK offers a free trial and paid subscription plans. Pricing, included features and trial length are described on our pricing page.

• Trial. New users get a 7-day free trial. No credit card is required to start the trial unless explicitly stated during checkout.
• Subscriptions. Paid plans renew automatically (monthly or annually depending on the variant you selected) until you cancel.
• Payment processor. Payments are processed by Lemon Squeezy, our merchant of record. Lemon Squeezy is responsible for collecting and remitting applicable sales tax, VAT or GST in your jurisdiction.
• Cancellation. You can cancel anytime from your billing portal. Cancellation stops the next renewal but does not refund the current billing period (see refunds below).
• Price changes. If we change subscription prices, we will notify you at least 30 days before the change takes effect on your next renewal.

5. Refund policy

We offer a full refund within 7 days of your first paid invoice for any reason. Renewal invoices on long-running subscriptions are not eligible for refund, but you can cancel anytime to stop future charges. To request a refund, contact us using the details in section 16.

6. Acceptable use

You agree not to:

• Use the Service for unlawful purposes, including money laundering, fraud or sanctions evasion.
• Reverse engineer, decompile, scrape or attempt to extract source code from the Service, except where permitted by applicable law.
• Interfere with or disrupt the Service, including overloading our APIs, bypassing rate limits or probing for vulnerabilities outside of an authorized program.
• Resell, sublicense or share your account with other people or organizations.
• Upload content that is illegal, infringing, defamatory or harmful.

7. Your data & content

You retain all rights to the portfolio data, asset entries, notes and other content you store in the Service ("Your Content"). You grant us a limited license to host, process, transmit and display Your Content solely as needed to operate, secure and improve the Service for you.

You can export or delete Your Content at any time. Deletion is permanent and cannot be undone, so make a backup first if you want to keep a copy.

8. Intellectual property

The FortuneOK brand, logos, design, software, code, copy and underlying technology are owned by FortuneOK and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted by implication.

9. Third-party services

The Service depends on third-party providers, including (but not limited to) Lemon Squeezy (payments), Supabase (database and authentication), Resend (transactional email), Google (sign-in) and Financial Modeling Prep (market data). Their terms and privacy policies apply when you use those features.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy of data. We do not warrant that the Service will be uninterrupted, error-free or secure.

12. Limitation of liability

To the maximum extent permitted by law, FortuneOK will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) USD 50.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continuing to provide the Service to you creates an undue risk to us or other users. On termination, the sections of these Terms that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will survive.

14. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the competent courts located in the United States for any dispute that cannot be resolved informally.

15. Changes to these terms

We may update these Terms from time to time. If a change is material, we will notify you by email and update the "Last updated" date above. Your continued use of the Service after the update takes effect constitutes acceptance of the revised Terms.
